These Terms are designed for Equipper's current service: connecting customers and suppliers. Bookings, payments and hire contracts happen directly between users.
1. About these Terms
These Terms apply when you visit Equipper, create an account, publish content, send an enquiry, respond to a hire request or otherwise use the service. By using Equipper, you agree to these Terms and our Privacy Policy.
You must be at least 18 years old and legally able to enter contracts. If you use Equipper for a business, you confirm that you are authorised to act for that business.
Back to contents2. What Equipper does
Equipper is an online connection and enquiry service. It helps customers find equipment suppliers and services, publish hire requests, request quotes and communicate with suppliers.
Equipper does not own, supply, hire, operate, deliver, inspect or maintain equipment. Equipper is not a party to any quote, booking, hire agreement, payment, bond, cancellation, transport arrangement or other transaction made between users.
Back to contents3. Accounts and security
- Provide accurate, current information and keep it updated.
- Keep your password and account access secure, and tell us promptly if you suspect unauthorised use.
- Use only your own identity or a business you are authorised to represent.
- Do not sell, transfer, share or create accounts to avoid a restriction or suspension.
Back to contents4. Customers and hire requests
Customers must submit genuine enquiries and hire requests. Before entering a hire arrangement, customers should independently confirm the supplier's identity, equipment condition and suitability, pricing, GST treatment, availability, licences, operator qualifications, insurance arrangements, delivery terms and written hire conditions.
Customers remain responsible for site access, safe operating conditions, required permits, competent operators and complying with applicable workplace health and safety laws.
Back to contents5. Listings, quotes and direct transactions
Listings, supplier profiles, prices, availability, reviews and responses are supplied by users. Unless clearly stated otherwise, prices are indicative and users must confirm whether GST, transport, fuel, operators, attachments, cleaning, damage waivers, bonds or minimum hire periods apply.
Any hire or service contract is made directly between the customer and supplier. Each party is responsible for reading, agreeing and keeping a copy of the final quote and hire terms.
Back to contents6. Content and acceptable use
You keep ownership of content you submit. You give Equipper a non-exclusive, worldwide, royalty-free licence to host, reproduce, resize, display and distribute that content only as reasonably needed to operate, secure and promote the Equipper service and your public listings or profile. This licence ends when the content is deleted, except for backups, legal records and content already shared with another user.
You must have the right to upload all text, photos, logos and documents you submit.
- Do not post false, misleading, copied, defamatory, abusive, discriminatory, dangerous or unlawful content.
- Do not impersonate another person or business, manipulate reviews, scrape data, send spam or introduce malicious code.
- Do not use another user's contact details for unrelated marketing, resale or harassment.
Back to contents7. Reviews, reports and moderation
Reviews must describe a genuine Equipper interaction and reflect the reviewer's honest experience. Equipper may hold, edit only for privacy, reject or remove content that appears unlawful, fraudulent, irrelevant, abusive or contrary to these Terms.
Moderation is risk-based and is not an endorsement, verification or guarantee. Equipper is not required to pre-screen every listing, message or review.
Back to contents8. Safety and verification
An ABN lookup or other public business information may help identify a business, but it does not mean Equipper has verified the supplier, equipment, insurance, licences, financial standing or quality of work. Users must carry out checks appropriate to the job and level of risk.
Information on Equipper is general information, not engineering, safety, legal, tax, insurance or financial advice.
Back to contents9. Fees and future paid features
Equipper may introduce paid listings, subscriptions or optional services in the future. We will show the price, billing period, inclusions and cancellation terms before you agree to a charge. We will not retrospectively charge for a free feature without your agreement.
Back to contents10. Availability and third-party services
We work to keep Equipper available and accurate, but the service may occasionally be unavailable, delayed or contain errors. We may change or retire features where reasonably necessary, including for security, legal or operational reasons.
Equipper uses third-party hosting, authentication, storage, email, analytics and business lookup services and may link to external websites. Those services have their own terms and privacy practices.
Back to contents11. Australian Consumer Law and liability
Nothing in these Terms excludes, restricts or modifies a right, guarantee, remedy or liability that cannot lawfully be excluded, including rights under the Australian Consumer Law.
To the maximum extent permitted by law, Equipper is not responsible for user content, a supplier or customer's conduct, equipment condition or performance, site safety, loss arising from a direct hire transaction, or indirect or consequential loss. Where the law allows Equipper to limit liability for a failure of our service, our liability is limited to supplying the service again or paying the reasonable cost of having it supplied again.
Back to contents12. Suspension and account closure
We may restrict content or suspend or close an account where reasonably necessary to investigate fraud, safety concerns, unlawful activity, repeated complaints, security risks or serious or repeated breaches of these Terms. Where appropriate, we will give notice and an opportunity to respond.
You may stop using Equipper and request account deletion. Some records may be retained where reasonably needed for security, dispute resolution, legal compliance and backups, as explained in our Privacy Policy.
Back to contents13. Disputes, changes and governing law
Users should first try to resolve transaction disputes directly. Equipper may provide communication records or reasonable assistance but is not obliged to decide a dispute between users.
For a dispute with Equipper, contact us first so we can try to resolve it. These Terms are governed by the laws of New South Wales, Australia. We may update these Terms and will provide reasonable notice of material changes. Continued use after the effective date of an update means the updated Terms apply.
